Tilt bits

I just sent in a question for the Security Now show.

I listened to shows 74 and 75 about Windows Vista DRM, and there is something that is not clear to me.

If card vendors have to code tilt bits and periodic validity checks into their products so that Vista can assure itself that the protected content that is currently being played is not being pirated, then surely open source developers developing drivers won’t have to support either unless they want to play back protected content. So hardware that is developed in the future can be supported by open source developers even if this hardware has to support tilt bits and periodic validity checks for Vista.

Hopefully my question will make it to the air.
